Allied-General, et al.) are holders of Construction Permit No. CPCSF-4 issued by the Atomic Energy Commission on Decem-ber 18, 1970 for the construction of the Separations Facility of the Barnwell Nuclear Fuel Plant. The original date of com-pletion of construction, as set forth in the Construction Per-mit, was January 1, 1974. By letter of August 13, 1973, from Mr. Leland C. Rouse of the Atomic Energy Commission, this date was extended to December 31, 1976.

As your records will show, by letter of November 11, 1976, to Mr. R. M. Bernero of the Nuclear Regulatory Commis-sion, Allied-General, et al., requested extension of the latest completion date to December 31, 1978. In the absence of action by the NRC, the Ccnstruction Permit remained in effect under the provisions of 10 CFR 52.109. The-status of the Construc-tion Permit was discussed by the Commission in footnote 22 of the Commission's May 8, 1978 Memorandum of Decision in In the Matter of Mixed Oxide Fuel, 7 NRC 711, 731.

In view of the circumstances, it is not clear whether a further extension request is necessary for the Construction Permit to remain in effect past December 31, 1978. Neverthe-less, to avoid uncertainty Allied-General, et al., herewith 7812180/2/7 ms

Mr. L. C. Rouse

  • November 9, 1978 requests that the latest completion date be extended to December 31, 1981. This further extension request results from a series of events--particularly actions of the Federal Government--with which the Commission is fully familiar, and is primarily directed at facilitating the performance of the continuation of the research program being conducted by~ Allied- ~

General for the U.S. Department of Energy.
