Dear Sirs:

Allied-General Huclear Services, Allied Chemical Nuclear Products, Inc., and General Atomic Company (hereinaf ter Allied-General, et al) are holders of Construction Permit No. CPCSF-4 issued by the Atomic Energy Commission on December 18, 1970 for the con-struction of the Separations Facility of the Barnwell Nuclear Fuel Plant.

The original date of completion of construction, as set forth in the Construction Permit, was Jan-uary 1, 1974. By letter dated August 13, 1973, from Mr. Leland C. Rouse of the Atomic Energy Commission, this date was exterded to December 31, 1976.

As your records will show, by letter dated November 11, 1976, Allied-General, et al, requested the NRC to extend the latest completion date to December 31, 1978.

In the absence of action by the NRC, the Construction Permit remained in effect under the s

provisions of 10 CFR 2.109. The status of the Construction Permit was discussed by the Commission in footnote 22 of the Commission's May 8,1978 Memorandum of Decision in In the Matter of Mixed 0xide Fuel, 7 NRC 711, 731.

Thereafter, by letter to NRC dated November 9,1978, Allied-General, et al, requested that the latest completion date be extended to December 31, 1981; it was noted in that letter that it was not clear whether such a further extension request was then necessary for the Construction Permit to remain in effect, but that the request was being sub-mitted to avoid uncertainty.

On November 23, 1981, to avoid such uncertainties, and I

to maintain the status quo as to the Construction Pemit, it was requested that a further extension be granted to September 30, 1982.

No express action has been taken by the Commission on any of these requests.

At the time the most recent request for extension of the completion date was submitted, it was believed that a final decision would be made as to the future of the Barnwell Nuclear Fuel Plant prior to September 30, 1982. Options are still being explored, and it now appears evident that such decision will require additional time. Therefore, to maintain status quo as to the Construction Pemit, it is requested that a fur er ten-sion be granted to September 30, 1983.
