l COUNTY OF MONTGOMERY j AFFIDAVIT OF LELAND C. ROUSE l i Personally appeared before me, Leland C. Rouse, who being duly sworn, deposes and states that:

1. He has been employed by the U.S. Nuclear Regulatory Commission, or its predecessor organization, the Atomic Energy Commission, for 23 years. 1 1

2. For 20 years, he has been responsible for, or working on, licensing of nuclear fuel cycle facilities. J

3. He is familiar with Construction Permit No. CPCSF-4 issued to Allied-General I

NuclearServices(AGNS).

4. The Construction Permit is specific to /GNS' and its owners and the Barnwell Muclear Fuel Plant site. The Construction Permit ~is a license under the Atomic Energy Act. Section 184 of the Atonic Energy Act precludes transfer of contr01 of the license, voluntarily or involuntarily, directly or I indirectly, without first fully informing the Nuclear P.egulatory Commission of the proposed transfer of control and securing the Nuclear Regulatory .

Commission's consent in writing. Transfers of control of the license can

i result from sale of any part of a licensed facility subject to the license, its conveyance, or sale of controlling stock or other interest. 1

5. There cannot be any operation of the AGNS plant without an operating license issued by the Nuclear Regulatory Commission.

6. The transfer or amendment of the Construction permit, or issuance' of any operating license would require that an application requesting such be filed with the Nuclear Regulatory Conrnission and then be reviewed and approved by the Muclear Regulatory Commission according to its regulations and procedures before any transfer could be made or operations could be conducted.

7. The Construction Permit can be terminated upon request of the Construction Permit holder upon the licensee meeting such conditions as the. Nuclear j Regulatory Commission deems necessary. It con also be terminated by the  !

Nuclear Regulatory Commission by order without such a request. In the latter case the licensee can request a hearing before the Nuclear Regulatory Commission.
