PROPOSED IMPOSITION OF CIVIL PENALTY - $112,500 This is' to inform the Comission that a Notice of Violation and Proposed l Imposition of Civil Penalty in the amount of $112,500 will be issued on or '

about November 26, 1990 to Illinois Power Company. This action is based on two separate problems: (1) the failure to promptly identify and take appro-priate corrective action for a degraded shutdown service water system, and (2) reactor startup with two emergency diesel generators inoperable due to i the unavailability of cooling water. Though the NRC identified the first violation, extensive licensee corrective actions offset escalation above the base civil penalty. Although the licensee identified the second violation, only 25% mitigation was applied because the diesel generator failure is considered self-identifying. A 100% escalation was applied for prior notice due to previous Resident Inspector discussions with Operations Management concerning the need to communicate the new method of setting the throttle valves with all appropriate people.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted,

mitigated,_or imposed by Order.
