IMPOSITION OF CIVIL PENALTY - $75,000 By EN 88-41 dated May 26, 1988 the Commission was notified of the intent of the staff to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Seventy-Five Thousand Dollars ($75,000) to Illinois Power Company.
This action was based on a violation involving environmental qualification of equipment important to safety.
The licensee responded to the Notice in a letter dated June 29, 1988. After careful consideration of the licensee's response, the staff has concluded that one of the examples in the violation should be withdrawn. However, the withdrawal of that example does not change the violation's significance or affect the escalation of the civil penalty.
Accordingly, an Order Imposing Civil Penalty in the amount of $75,000 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
