- EN 88-41 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Illinois Power Company (EA 88-90)

(Clinton Unit 1)

Subject:

PROPOSED IMPOSITION OF CIVIL PEHALTY - $75,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Seventy-Five Thousand Dollars

($75,000) will be issued on or about June 1,1988 to Illinois Power Company.

This action is based on i Severity Level III violation for failure of the licensee to assure that electrical equipment important to safety, involving electrical connectors and junction boxes, were environmentally qualified, resulting in a significant deficiency which could have led to equipment failures during postulated accident conditions in multiple safety systems. The escalation and mitigation factors of the Enforcement Policy were considered and resulted in 50% escalation. While the licensee took prompt corrective actions, prior notices had been issued by the NRC and multiple safety systems were affected by the violations.

The special Enforcement Policy for EQ violations in Generic Letter 88-07 is not applicable because Clinton Unit I was granted an operating license after the November 30, la85 EQ deadline. Therefore, the regular Enforcement Policy was applied.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice June 1, 1988 Telephone Notification of Licensee June 1, 1988 The State of Illinois will be notified.

The licensee has thirty days frc. the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
