((OTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Lic'ensee: Illinois Power Company EA Nos: 97-133 and 97-467 Clinton Power Station Docket No. 50~t6

Lir.cnse No. NPF o2 Feblect: EXERCISE OF ENFORCEMENT DISCRETION This is to inform the Commission the staff intends to exercise enforcement discretion per Section Vll.B.6 of the Enforcement Policy and not issue a citation or propose a civil penalty for 21 violations idatified at the Clinton Power Station (CPS). The violations involve: (1) procedure adherence and adequacy problems, (2) f ailure to adequately implement the corrective action program and,(3) inadequate control of materials and work procedures. A letter describing this action will be issued on or about January 8,1998.

The decision to apply enforcement discretion was based on consideration of the following:

(1) significant NRC enforcement action was taken (EAs96-412, 97-001,97-002, 97-060, and 97-132; Notice of Violation and Proposed imposition of Civil Penalties of $450,000, issued on June 9,1997, for a Severity Level 11 problem and several Severity Level 111 problems) against the Illinois Power Company for several programmatic breakdowns (including procedure adherence / adequacy and use of an unaporoved lubricant on safety related breakers) for which CPS's corrective actions encompassed the root causes for these violations; (2) some of the violations were related to activities before the enforcement action was issued; (3) the violations would not be classified at a severity level higher than Severity Level Ill; and (4) lilinois Power Company will meet with the NRC to explain their efforts to resolve these issues prior to restart as reflected in the NRC's September 26,1997, Demand for Information (EA 97-435). Effective corrective actions must be demonstrated prior to restart to satisfy the NRC Manual Chapter 0350 process, it should be noted that the licensee has not been specifically informed of the enforcement action. The schedule for licensee notification is that the letter and inspection report exercising enforement discretion will be issued on or about January 8,1998.

The State of Illinois will be notified.
