By notice in the Federal Register dated August 4, 1977, the r,-

3 sion issued amendments to 10CFR71, effective October 18, 1977.- The amen om s upgrade requirements for quality assurance in the design, fabrication, assembly, testing, use and maintenance of packagings for shipping and transport of licensed radioactive materials. Further, the amendments require a statement of compliance with 10CFR71.51, Appendix E, " Quality Assurance Criteria for Shipping Packages for Radioactive Material," to be f ' ~ ed with the Commission along with a description of our program for implementing Appendly E.

To facilitate the implementation of the above regulation, spent fuel shipping casks have been reclassified as safety-related equipment. With this reclassification, our compliance with 10CFR50, Appendix B, " Quality Assurance Criteria for Nuclear Power Plants and Fuel Reprocessing Plants," which was pre-viously established by the Commission's approval of our current quality assurance program, is tantamount to compliance with 10CFR71.51, Appendix E.

The requirement to file both a statement of compliance and a description of our quality assurance program governing shipping casks, therefore, is considered to have been met.

In addition,10CFR71.51 requires that packagings for shipment of licensed radioactive material, approved for this use prior to July 1,1978, be deemed to have been designed, fabricated and assembled in accordance with a quality assurance program which satisfies the provision of 10CFR71.51(a).

Enclosed is a statement from our spent fuel shipping cask supplier certifying NAC-1 Casks to be designed, fabricated and tested in conformance with the pro-visions of 10CFR71.51 that were in effect at the time of package approval.

The NAC-1 Spent Fuel Shipping Cask is used for shipment of radioactive materials in accordance with the authority granted by the Nuclear Regulatory Commission in Certificate of Compliance No. 6698, Revision Number 5.

Para-graph 13 of the Certificate stipulates that the requirements of Subpart D of 10CFR71 are applicable to each package. Paragraph 16 requires that the NAC-1 casks be fabricated in accordance with the Nuclear Assurance Corporation (NAC) Quality Assurance Program dated January 28, 1974 as supplemented or.

April 10, 1974.

This letter is to certify that casks NAC-1A, -1B, -lc and -lD vere de-signed, fabricated and tested in accordance with the above noted stipulations and requirements.

Subpart D, as referenced in the certificate, includes Paragraph 71.51 and the NAC-1 Casks are in conformance with the provisions of this part that were.in effect at the time of package approval.
