Mr. Duke, By letter dated, July 29, 2019, (ADAMS Accession Number ML19210C880), PSEG Nuclear LLC (PSEG) submitted a license amendment request for Hope Creek Generating Station and Salem Generating Station Units 1 and 2. The proposed amendment revises the operating licenses to delete certain license conditions which impose specific requirements on the decommissioning trust agreement, on the basis that upon approval of this amendment, the provisions of 10 CFR 50. 75(h) that specify the regulatory requirements for decommissioning trust funds will apply to PSEG Nuclear. The option to delete license conditions relating to the terms and conditions of decommissioning trust fund agreements and, instead, conform to the 10 CFR 50. 75(h) regulations adopted in 2002 is specifically contemplated by the provisions of 10 CFR 50.75(h)(5) and the generic finding of no significant hazards consideration in 10 CFR 50.75(h)(4). The proposed amendment also removes legacy financial requirements associated with the license transfer from PSE&G to PSEG Nuclear relative to maintaining available funding for an extended shutdown. This facility operating license requirement is a legacy requirement from the license transfer and is not required to ensure PSEGs financial qualifications to cover estimated operating costs for the period of the licenses.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.

The NRC staff has estimated that this licensing request will take approximately 180 hours7.5 days <br />1.071 weeks <br />0.247 months <br /> to complete. The NRC staff expect to complete this review in approximately 12 months, which is August 2020. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager.

These estimates are based on the NRC staffs initial review of the application and they could change, due to several factors including requests for additional information, unanticipated addition of scope to the review, and review by NRC advisory committees or hearing-related activities. Additional delay may occur if the submittal is provided to the NRC in advance or in parallel with industry program initiatives or pilot applications.
