On August 28, 2018, the NRC staff held a Category 3 public meeting, in 3WFN Room 01C05 from 9:00 AM until 12:00 PM, for the final rule amending 10 CFR Part 74, Material Control and Accounting of Special Nuclear Material. The purpose of the meeting was to obtain input from stakeholders on any current or potential challenges that would impact their ability to implement the final rule within 6 months after publication in the Federal Register. The draft final rule is scheduled to be provided to the Commission by the end of September 2018.

The arrangements for the meeting were posted on www.nrc.gov, Public Meeting page. The meeting material was also posted on the Public Meeting web page and on www.regulations.gov in Docket ID No. 2009-0096 (for the presentation and a table showing the changes in the rule text) and in Docket ID No. 2013-0195 (for the six final draft guidance documents that address the draft final rule). Remote attendance at the meeting was available through webinar and teleconference. The teleconference was operator-assisted to provide coordination of participant input from the 43 lines that were occupied during the meeting. In addition to the remote participants, 8 NRC staff, 2 representatives from the Nuclear Energy Institute, and 3 licensee representatives attended the meeting in person. Altogether, the participants included licensee representatives from nuclear power reactors, non-power reactors, Category III facilities, Category I facilities, and an organization that intends to submit an application for a Category II facility. The NRC staff provided an overview presentation on the changes in the draft final rule. Paper copies of the presentation and the table showing the changes in the rule text were available in the meeting room. The remote participants were able to view the presentation through the webinar.

The participants discussed the implications of the changes in the final rule text for implementation by licensees, including four areas that may affect the implementation time: (1) general performance objectives, (2) item control system requirements and exemptions, (3) procedures for tamper-safing, and (4) designation of material balance areas, item control areas, and material custodians. The meeting participants raised concerns about potential challenges to implementing the modified item control system and the modified exemptions within 6 months.

These challenges would include the time needed to complete modifications to MC&A procedures and related processes. Those licensees that are required to have an NRC-approved MC&A plan stated that a longer implementation period would be necessary if they needed to submit revised MC&A plans to the NRC for review and approval prior to implementation.

The NRC staff stated that it would take the industry concerns into consideration in the proposed implementation period included in the Commission rulemaking documents.
