Title:

Meeting between the U.S. NRC and Tennessee Valley Authority to Discuss Topics Associated with Pre-Application on Matters Related to the Development of a Construction Permit Application for the Clinch River Nuclear Site (Docket No. 99902056)

The purpose of this meeting was to discuss topics associated with Tennessee Valley Authority's (TVAs) preparation of a construction permit application for the Clinch River Nuclear Site that may require clarification and/or technical interactions. Specific topics discussed were associated with the following subject area related to the submittal of the Preliminary Safety Analysis Report (PSAR) and Environmental Report (ER) for the Clinch River Nuclear (CRN) Site:

Two years of data for the monitoring of groundwater to establish baseline conditions prior to construction and operation, as described in the Environmental Report and the Final Environmental Impact Statement Prior to the public meeting, topical areas for discussion were provided in the Related Documents section of the public meeting notice available as Agencywide Document Access and Management System (ADAMS) accession number ML22230C938. NRC Project Managers were present to give feedback to TVA on the above topics.

Summary of Meeting TVA provided an overview of the plan to address groundwater monitoring in order to establish a baseline, for the two years as described in the CRN Site ER Sections 6.3.2.2 and 6.6.2.2 and FEIS Section 4.2.4.2. TVA noted that the plan for the Construction Permit (CP) monitoring plan is to gather one year of groundwater data replicating the parameters and information gathered for the one-year sampling program conducted for the Early Site Permit (ESP) application to cover a total of two years of groundwater monitoring data. Therefore, eight quarters of groundwater sampling information would be evaluated and compared during the CP application review. TVA noted potential differences in terminology when referring to future groundwater monitoring timeframes, and referred to Regulatory Guide 4.2, Preparation Of Environmental Reports for Nuclear Power Stations, Section 2.2.4 for clarification of the purpose of the pre-application monitoring program.

As noted in previous public meetings for early engagement of state agencies, NRC staff encouraged TVA to communicate any sampling plans to the Tennessee Department of Environment & Conservation (TDEC) as TDEC has expressed interest in groundwater sampling results during the ESP application. NRC Staff also noted that ER Section 6.2, Radiological

Monitoring, Table 6.2-1 lists preoperational monitoring durations for various environmental media, and groundwater monitoring is described as a one-year period while the environmental monitoring program encompassing all of the listed environmental sampling media is two years.

NRC staff noted that a two-year quarterly groundwater monitoring program is described in TVAs Programmatic Environmental Impact Statement for the CRN Site in response to a comment. NRC Staff noted that a staggered two-year period combining the ESP and CP groundwater monitoring programs may be adequate; however, staff would need to evaluate the information during the CP application prior to acceptance. In addition, NRC staff noted that any differences from the ESP ER or previous determinations should be explained in the CP ER for the staffs evaluation in the CP EIS. NRC staff noted the opportunity to further discuss this and other topics at future meetings.

A question from the public related to the location of the SMR and TVA and NRC staff confirmed that the site in question is the CRN Site in Oak Ridge, TN.
