Mr. Wengert, Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 50.55a(z), alternatives to the requirements may be used when authorized by the U.S. Nuclear Regulatory Commission (NRC) if the licensee demonstrates that (1) the proposed alternative would provide an acceptable level of quality and safety or (2) compliance with the specified requirements would result in hardship or unusual difficulty without a compensating increase in the level of quality and safety.

In letter dated November 16, 2016 (ML16321A412, (TAC #MF8853)), Entergy Operations submitted an Inservice Testing relief request, VRR-ANO1-2017-1, seeking NRC authorization for Arkansas Nuclear One. This request stated that the relief was based on a determination that compliance with the specific code requirements resulted in an unusual difficulty without a compensating increase in the level of quality or safety; therefore the request should be granted pursuant to 10 CFR 50.55a(z)(2). The request states that the current request was a re-submittal of a previously approved request and cited the submittal of the approval (ML081130082).

Upon review of the current request, the NRC staff noted that the letter approving the earlier request was based on the alternative under 50.55a(a)(3)(i) [now 50.55a(z)(1)]. The NRC has requested an explanation of the difference between the previous NRC approval and the current Entergy request.

The original request (VRR-ANO1-2007-1) that formed the basis for the current request is dated November 29, 2007 (CNRO-2007-00042, ML073511442). In the approval letter from the NRC (dated April 30, 2008, Arkansas Nuclear One, Unit No. 1 - Approval of Relief Request for Arkansas Nuclear One Unit 1 Fourth 10-Year Pump and Valve Inservice Tesing Program (TAC NOS. MD7709 and MD7710, ML081130082), the staff stated that they had reviewed relief request VRR-ANO1-2007-1 and concluded that the proposed alternative would provide an acceptable level of quality and safety and therefore, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 50.55a(a)(3)(i), relief request VRR-ANO 2007-1 was authorized.

Based on the information above and the information provided in the aforementioned November 16, 2016 Entergy letter (ML16321A412, TAC #MF8853), Entergy Operations believes it has demonstrated that the proposed alternative would provide an acceptable level of quality and safety (10 CFR 50.55a(z)(1) and requests that the current ANO-1 Inservice Testing relief request for the Fifth 10-Year interval be approved based on that criterion.
