Subject:

Status of 2.206 Petition Regarding Apparent 50.9 Violation at Diablo Canyon Power Plant (MF8123 and MF8124)

Good afternoon Mr. Lochbaum, The Petition Review Board (PRB) initially recommends to accept the 2.206 petition regarding your concerns about an apparent violation of 10 CFR 50.9, Completeness and accuracy of information, by Pacific Gas & Electric (PG&E), concerning the alternate source term (AST) license amendment request for Diablo Canyon Power Plant, Units 1 and 2, for review. The PRBs initial recommendation is based upon the fact that your request meets the criteria for review under 10 CFR 2.206.

Per Management Directive 8.11, you have the opportunity to comment on the PRBs initial recommendation in the form of a meeting or teleconference with the PRB. This meeting or teleconference, if held, is an opportunity for you to provide any relevant additional explanation and support for the request in light of PRB's recommendations. After this discussion, PRB will consider the need to modify any of its recommendations. The final recommendations will be included in the acknowledgment letter.

For your awareness, NRC issued a Request for Additional Information (RAIs) on September 7, 2016 to PG&E as a followup to the technical discussion during the AST audit, which was conducted on August 3 - 4, 2016. You can find the RAIs in ADAMS using ADAMS Accession No. ML16251A091.

Please let me know if you have any additional questions on the 2.206 petition process. If you have additional questions, I can give you a call tomorrow afternoon at your convenience.

Thank you, Maggie Watford Petition Manager, Plant Licensing Branch IVI Division of Operating Reactor Licensing U.S. Nuclear Regulatory Commission Phone: 3014151233 Email: Margaret.Watford@nrc.gov 1
