CALVERT CLIFFS NUCLEAR POWER PLANT, UNIT NOS. 1 AND 2, AND CALVERT CLIFFS INDEPENDENT SPENT FUEL STORAGE INSTALLATION-WITHDRAWAL OF AN AMENDMENT REQUEST (TAC NOS. MF2621 AND MF2622)
Dear Mr. Gellrich:
By letter dated August 14, 2013 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML13228A265), Constellation Energy Nuclear Group, LLC 1 , applied for an amendment to the Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2 (Calvert Cliffs), and the Calvert Cliffs Nuclear Power Plant specific license Independent Spent Fuel Storage Installation (ISFSI) Facility Operating License Nos. DPR-53, DPR-69, and SNM-2505.
The proposed change would have granted Calvert Cliffs, and the co-located specific license IFSI, authorization to use preemption authority allowed by Section 161A of the Atomic Energy Act (preemption authority). Subsequently, by letter dated January 23, 2015 (ADAMS Accession No. ML15026A102), Exelon Generation, LLC (the licensee}, withdrew the amendment request.
In the licensee's withdrawal request, they stated that the Attorney General (AG) for the State of Maryland (MD) concluded that:
... if the NRC authorizes the weapons for use by security personnel at the Calvert Cliffs Nuclear Plant as part of the required security plan. [then] the facility falls within the exemption provided in State law [(the Maryland Firearms Safety Act of 2013)].
Based on this determination by the MD State AG and the licensee's request to withdraw the license amendment request (LAR), the NRC issued a letter on June 19, 2015 (ADAMS Accession No. ML15114A435), which relaxed the requirements of Commission Order EA-13-092 (designation order). This letter relieved:
... Calvert Cliffs, and the co-located specific license ISFSI from the requirements to subject all security personnel who require access to firearms in the performance of their official duties to a firearms background check as described in Attachment 3 of the designation order.
1 By Order dated March 24, 2014 (ADAMS Accession No. ML14105A472), the NRC staff ordered the direct transfer of operating authority from Calvert Cliffs, LLC (a subsidiary of CENG), to Exelon Generation, LLC.
