Dear Mr. Spina:
By letter dated August 14, 2013, (ML13228A265 and ML13228A266), Constellation Energy Nuclear Group, LLC (Constellation Energy), submitted an application to U.S. Nuclear Regulatory Commission (NRC, Commission), pursuant to Section 161 A of the Atomic Energy Act U.S.C.
2201 a, requesting approval of preemption authorities related to certain weapons. Constellation Energy requested preemption authorities on behalf of its, NRC licensed, subsidiary companies; Calvert Cliffs Nuclear Power Plant, LLC, Nine Mile Point Nuclear Station, LLC, and R.E. Ginna Nuclear Power Plant , LLC.
In accordance with the provisions of Title 10 of the Code of Federal Regulations (CFR),
Sections 50.90 and 72.56, Constellation Energy proposes changes to the licenses of its subsidiaries to reflect Commission authorization to requested Section Section 161 A preemption authority to permit use of certain weapons at Calvert Cliffs Nuclear Power Plant, units 1 and 2, Nine Mile Point Nuclear Power Plant, Units 1 and 2, and R.E. Ginna Nuclear Power Plant.
These facilities are within the interim class of facilities designated by the Commission to be amended to reflect the new authority.
The purpose of this email is to provide the results of the NRC staff's acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review.
The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
Consistent with Section 50.90 of 10 CFR, an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.
