Mike Miller, Jr. (President of the Senate, Maryland General Assembly), dated January 15, 2015 In Reference 1, NRC designated an interim class of licensed facilities eligible to apply for preemption authority to allow the possession and use of firearms, ammunition, and other devices such as large-capacity ammunition feeding devices, notwithstanding local, State, and certain Federal firearms laws that may prohibit such possession and use. In Reference 2, Constellation Energy Nuclear Group, LLC applied for Commission approval to use the preemption authority allowed by Section 161a of the Atomic Energy Act for its licensed facilities at Calvert Cliffs Nuclear Power Plant, Nine Mile Point Nuclear Station, and the R.E.

Ginna Nuclear Power Plant.

In the Reference 3 letter, the U.S. Nuclear Regulatory Commission requested additional information. Reference 4 provided the response to the NRC's request. In the Reference 5 letter, Consent and Hearing Waiver Forms were provided for the Nine Mile Point Nuclear Station and R.E. Ginna Nuclear Power Plant.

In Reference 6, the Attorney General of Maryland concluded that, "if the NRC authorizes the weapons for use by security personnel at the Calvert Cliffs Nuclear Plant as part of the required security plan, [then] the facility falls within the exemption provided in State law."

In view of this determination, we are withdrawing our request for the Calvert Cliffs Nuclear Power Plant.
