Dear Mr. Flores:
This letter provides the final significance determination of the preliminary Greater-than-Green finding identified in Nuclear Regulatory Commission (NRC) Inspection Report 05000445/2014404; 05000446/2014404 (ML15065A225), dated March 6, 2015. The detailed description of the finding is contained in Section 4OA5 of that inspection report. The finding was security-related and the deficiencies were promptly corrected or compensated for, and as such, the plant was in compliance with applicable physical protection and security requirements before the inspection team left the site.
By letter dated April 2, 2015, you provided a response to the NRC staffs preliminary determination regarding the subject finding. After thoroughly considering the information developed during our inspection and the information you provided in your letter, we have concluded that the inspection finding is appropriately characterized as Greater-than-Green, as described in the attached Notice of Violation (Notice).
You have 30 calendar days from the date of this letter to appeal the staffs determination of significance for the identified Greater-than-Green finding. Such appeals will be considered to have merit only if they meet the criteria provided in NRC Inspection Manual Chapter 0609, Significance Determination Process, Attachment 2. An appeal must be sent in writing to the Regional Administrator, Region IV, 1600 E. Lamar Blvd., Arlington, TX 76011-4511. The NRC also determined that the finding involves a violation of NRC requirements as cited in the attached Notice of Violation (Notice). In accordance with the NRC Enforcement Policy, NRC issuance of this Notice is considered an escalated enforcement action because it is associated with a Greater-than-Green finding.
The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence, and the date when full compliance was achieved is already adequately addressed on the docket in NRC Inspection Report No. 05000445/2014404; 05000446/2014404 (ML15065A225), dated March 6, 2015, and your letter dated April 2, 2015. Therefore, you are not required to respond to this letter.
However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201, if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to provide additional information, then you should follow the instructions specified in the Notice.
Because this issue involves Security-Related Information, if you choose to respond, your response will not be made available electronically for public inspection in the NRC Public Document Room or from the NRCs Agencywide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html. If Safeguards Information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21.
Because plant performance for the Comanche Peak Nuclear Power Plant has been determined to be beyond the Licensee Response Column of the NRCs Reactor Oversight Process Action Matrix, as a result of the Greater-than-Green significance finding for Units 1 and 2, the NRC will use the Action Matrix to determine the most appropriate NRC response to the findings significance. We will notify you, by separate correspondence, of that determination.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice and Procedure," a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or in the NRCs Agencywide Documents Access and Management System (ADAMS),
accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html. However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosure will not be made available electronically for public inspection in the NRC Public Document Room or in the NRC's Agencywide Documents Access and Management System (ADAMS), accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html.
