After reviewing and fully considering the email response by the NRC Petition Review Board (PRB) related to licensed operations at the Florida Power & Light Company (FPL) - St. Lucie Unit-2 nuclear plant - it appears that the PRB failed to properly weigh and consider the significant nuclear safety issues identified in the March 2014 Enforcement Petition (2.206). Moreover, the PRB's response failed to address the substantial evidence in support of the petition which I presented to the board in a recent teleconference call directly related to the thousands of degraded tubes in the steam generators in Unit and the apparent improper structure and equipment modifications made by FPL to Unit-2.

Therefore, it would serve no purpose to further engage the NRC PRB in further support of the 2.206 petition -

but rather challenge through the courts - the final agency action in this matter.
