Dear Sir or Madam:
In Reference 1, the Nuclear Regulatory Commission (NRC) issued an Order for Interim Safeguards and Security Compensatory Measures to all operating nuclear power reactor licensees (EA 026). In Reference 2, the NRC issued an Order requiring compliance with Key Radiological Mitigation Strategies to Vermont Yankee Nuclear Power Station (VY) (EA-06-137).
In Reference 3, Entergy Nuclear Operations, Inc. (ENO) notified the NRC that it has decided to permanently cease operations of VY at the end of the current operating cycle. Once certifications for permanent cessation of operations and permanent removal of fuel from the reactor vessel are submitted to the NRC in accordance with 10 CFR 50.82(a)(1)(i) and (ii), per 10 CFR 50.82(a)(2),
the 10 CFR Part 50 license no longer will permit operation of the reactor or placement of fuel in the reactor vessel.
Pursuant to Section III.D of Order EA-02-026, a request to rescind Interim Compensatory Measure (ICM) B.1.a is provided in the enclosure to this letter. Additionally, pursuant to Section III.D of Order NOTICE: The enclosure of this letter contains "Safeguards Information." Upon separation of the enclosure from this letter this page becomes "DECONTROLLED."
SAFEGUARDS INFORMATION
SAFEGUARDS INFORMATION WVY 13-105 / Page 2 of 3 EA-06-137, a request to rescind this Order in its entirety is also provided in the enclosure. These rescission requests are part of the transition from an operating station to non-operating station. The enclosure to this letter contains Safeguards Information as defined by 10 CFR 73.21 and its disclosure to unauthorized individuals is prohibited by Section 147 of the Atomic Energy Act of 1954, as amended.
ENO requests rescission of these Orders by December 31, 2014 and that the rescissions become effective following submittal of the certifications required by 10 CFR 50.82(a)(1).
This submittal contains no new regulatory commitments.
