Dear Administrative Judges:

Consistent with the Commissions policy on notification of the Atomic Safety and Licensing Board (Board) and all parties of new, relevant, and material information, counsel for the U.S. Nuclear Regulatory Commission staff (Staff) hereby informs the Board and the parties that on June 17, 2015, the Staff approved exemptions from requirements of 10 C.F.R. §§ 50.75(h)(1)(iv) and 50.82(a)(8)(i)(A) for Entergy Nuclear Operations, Inc. (the licensee). These exemptions allow the licensee to withdraw funds from the Vermont Yankee decommissioning trust fund for irradiated fuel management activities without prior notice to the NRC. The Staff determined that the exemptions met the requirements for a categorical exclusion under 10 C.F.R. § 51.22(c)(25) and, accordingly, no environmental impact statement or environmental assessment was prepared in connection with the exemptions. The exemptions are available through the Nuclear Regulatory Commissions Agencywide Documents Access and Management System via Accession No. ML15128A219.
