OCONEE NUCLEAR STATION, UNITS 1,2, AND 3, REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NOS.

ME9024, ME9025, AND ME9026)

Dear Mr. Batson:

By letter dated April 18, 2013, Agencywide Documents Access and Management System (ADAMS) Accession No. ML131190040, you submitted two affidavits dated March 13, 2013, and March 14, 2013, both executed by Dennis Williford of AREVA NP Inc., requesting that the information contained in the following documents be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Section 2.390:

1. Report ANP-3208P, Revision 0, "Confirmation of Stress Relief for ONS-1, ONS-2, ONS-3, and CR-3 Core Support Shield Upper Flange Welds."
2. Report ANP-3186P, Revision 1, "ONS License Renewal Scope and MRP-189, Revision 1, Comparison."

The reasons given for requesting our withholding of this information were that the information includes test data or analytical techniques concerning a process, methodology, or component, the application of which results in a competitive advantage for AREVA NP, and that the information reveals certain distinguishing aspects of a process, methodology, or component, the exclusive use of which provides a competitive advantage for AREVA NP in product optimization or marketability.

We have reviewed your application and all of the supporting information in accordance with the requirements of 10 CFR 2.390 and have concluded that you have not provided sufficient justification for us to determine that the information sought to be withheld from public disclosure contains proprietary information. Some of the information is already publicly available, such as drawings of the reactor vessel and the surveillance specimen holder tubes (SSHTs), and descriptions of the problems with the SSHTs. For example, see the Oconee submittal and attachment dated June 28,2012, ADAMS Accession Nos. ML12187A214 and ML12187A215.

Also see the Oconee Updated Final Safety Analysis Report. Other information is of a type not likely to cause substantial harm to the competitive position of AREVA NP, such as Babcock &

Wilcox contract numbers for the original reactor vessel internals.

S. Batson -2 Accordingly, we have concluded that the information sought to be withheld from public disclosure does not meet the requirements of 10 CFR 2.390. Therefore, your request to withhold report ANP-3208P, Revision 0, and report ANP-3186P, Revision 1, from public disclosure is denied.

Within 30 days from the receipt of this letter, the subject documents will be placed in the U.S.

Nuclear Regulatory Commission's Public Document Room. If, within 30 days of the receipt of this letter, you request withdrawal of the documents in accordance with 10 CFR 2.390(c), your request will be considered in light of applicable statutes and regulations and a determination made whether the documents will be withheld from public disclosure and returned to you.
