In Reference 1, Pacific Gas and Electric (PG&E) submitted License Amendment Request (LAR) 11-07 to request NRC approval to replace the Diablo Canyon Power Plant Eagle 21 digital process protection system (PPS) with a new digital PPS that is based on the Invensys Operations Management Tricon Programmable Logic Controller, Version 10, and the CS Innovations, LLC (CSI) (a Westinghouse Electric Company), Advanced Logic System (ALS). The LAR format and contents in Reference 1 are consistent with the guidance provided in Enclosure E and Section C.3, respectively, of Digital Instrumentation and Controls (I&C) Revision 1 of Interim Staff Guidance Digitall&C-ISG-06, "Licensing Process," (ISG-06) (Reference 2). In Reference 3, the NRC Staff (Staff) documented its' acceptance of Reference 1 for review. In Open Item numbers 31,42, 72, 51.1 b, 51.3a, 51.3b, 51.4a, and 51.4b contained in Enclosure 2 of Reference 4, the Staff requested information related to PG&E document SCM 36-01, Revision 0, "Process Protection System Replacement Software Configuration Management Plan (SCMP)." The SCMP has been revised to address the open items in Reference

4. The SCM 36-01, Revision 1, is contained in Attachment 1 to the Enclosure and supersedes SCM 36-01, Revision 0, that was submitted in Reference
6. In Open Item number 71 contained in Enclosure 2 of Reference 4, the Staff requested that the CSI documents, "6002-10202, ALS-1 02 Design Specification," "6002-10206, ALS-102 FPGA Design Specification," and "6116-00100, Diablo Canyon Units 1 and 2 Process Protection System ALS-ASU Communication Protocol," documents be submitted.

CSI documents, "6002-10202, Revision 3, ALS-1 02 Design Specification," "6002-10206, Revision 1, ALS-102 FPGA Design Specification," and "6116-00100, Revision A, Diablo Canyon Units 1 and 2 Process Protection System ALS-ASU Communication Protocol," are contained in Attachments 3, 4, and 5 of the Enclosure of this letter, respectively.

In Open Item number 83 contained in Enclosure 2 of Reference 4, the Staff requested information on the scope of the software hazard analysis contained in CSI document, "6116-00000, Diablo Canyon PPS Management Plan." The CSI document 6116-00000 has been revised to address the open item in Reference

4. The CSI document, "6116-00000, Revision 4, Diablo Canyon PPS Management Plan," is contained in Attachment 6 of the Enclosure of this letter and supersedes 6116-00000, Revision 3, that was submitted in Attachment 5 to the Endosure of Reference
5. 4. The CSI document, "6116-00003, Revision 2, Diablo Canyon PPS VV Plan," is contained in Attachment 7 of the Enclosure of this letter and supersedes 6116-00003, Revision 1, that was submitted in Attachment 6 to the Enclosure of Reference
5. This letter contains CSI documents in Attachments 3 through 7 to the Enclosure with information proprietary to CSI. Accordingly, Attachment 2 to the Enclosure includes a CSI authorization letter, Affidavit AFF6116-00053-5, an accompanying affidavit, a Proprietary Information Notice, and a Copyright Notice. The affidavit is signed by CSI, the owner of the information.

The affidavit sets forth the basis on which the CSI proprietary information contained in Attachments 3 through 7 to the Enclosure may be withheld from public disclosure by the NRC, and it addresses with specificity the considerations listed in paragraph (b )(4) of 10 CFR 2.390 of the NRC's regulations.

PG&E requests that the CSI proprietary information be withheld from public disclosure in accordance with 10 CFR 2.390. Correspondence with respect to the CSI affidavit, copyright, or proprietary aspects of the application for withholding related to the CSI proprietary information provided in Attachments 3 through 7 of the Enclosure should reference CSI Affidavit AFF6116-00053-5 and be addressed to Scott Roberts, President, CS Innovations, LLC, 7400 E Tierra Buena Lane, Suite 101, Scottsdale, AZ 85260-1795.
