SUBJECT:

ENVIRONMENTAL ASSESSMENT AND FINDING OF NO SIGNIFICANT IMPACT RELATED TO EXEMPTION REQUEST FOR HI-STORM FLOOD/WIND CASK SYSTEM CONTINUOUS BASKET SHIM CANISTERS AT PERRY UNIT 1 INDEPENDENT SPENT FUEL STORAGE INSTALLATION

Dear Phil H. Lashley:

The staff has issued the environmental assessment and Finding of No Significant Impact related to your application for an exemption dated February 27, 2024 (Agencywide Documents Access and Management System [ADAMS] ML24058A180), as supplemented on March 22, 2024 (ML24082A132). The proposed action would allow VistraOps to load two MPC-89-CBS in the HI-STORM Flood/Wind cask system at the Perry Unit 1 ISFSI in the storage condition where the terms, conditions, and specifications in CoC No. 1032, Amendment No. 5 are not met, solely as it applies to the near-term planned loading of two non-compliant CBS canisters beginning in August 2024. This action, if approved, would be permitted under exemption from Title 10 of the Code of Federal Regulations (10 CFR) Part 72, sections 72.212(a)(2); 72.212(b)(3); 72.212(b)(5)(i); 72.212(b)(11) and 72.214.

The environmental assessment and Finding of No Significant Impact (ML24103A110) are being forwarded to the Office of the Federal Register for publication. If you have any questions, please contact me at (301) 415-8064, or Bernard White of my staff, at (301) 415-6577.
