Dear Mr. Lashley:

By letters dated January 28, 2021, January 29, 2021, and February 8, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML21028A796, ML21031A002, and ML21039A409, respectfully), Energy Harbor Nuclear Corp (the licensee) submitted relief requests VR-3, VR-4, VR-5, VR-6, VR-7, and VR-8 for Perry Nuclear Power Plant (Perry) proposing one-time extensions of testing for certain Perry valves scheduled for the spring 2021 refueling outage.

By emails dated February 16, 2021 (ADAMS Accession Nos. ML21054A174, ML21054A178, and ML21054A180), provided the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of these relief requests. The NRC staff concluded that the submittals provided technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed exemption in terms of regulatory requirements and the protection of public health and safety and the environment. Based on the information provided in the submittals and the assumption that the NRC would issue its regulatory decision by a written safety evaluation, the NRC staff expected to complete the reviews by March 31, 2021. On March 3, 2021, the NRC provided verbal authorizations of the proposed alternative VR-3, VR-4, VR-5, VR-6, VR-7, and VR-8 (ADAMS Accession Nos. ML21063A191, ML21063A192, ML21063A193, ML21063A195, ML21063A196, and ML21063A198, respectfully). These verbal authorizations signify the completion of the NRC initial review of the requests.

The purpose of this e-mail is to provide a corrected schedule for the completion of the staffs final written evaluations. Consistent with NRC Office Instruction LIC-102, Revision 3, Review of Relief Requests, Proposed Alternatives, and Requests to Use Later Code Editions and Addenda, the staff will issue the written evaluations within 150 calendar days after giving verbal authorization. As such, for all the submittals, the staffs final written evaluation is expected to be completed no later than July 31, 2021. If there are emergent complexities or challenges in our review that would cause changes to this forecasted completion date, the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager.
