Dear Mr. Harden:

The Region I Field Office, NRC Office of Investigations (01) initiated an investigation (Case No.

1-2009-025) on April 10, 2009, to determine whether a former contractor employed at Beaver Valley d!liberately withheld information when filling out a Personal History Questionnaire (PHO) to obtain unescorted access authorization. Based upon testimonial and documentary evidence developed by 01, the NRC did not substantiate that the contractor deliberately provided, with intent to deceive, false information to obtain unescorted access.

Specifically, the contractor provided convincing testimony that he did not think that he was required to disclose information about a 2004 alcohol-related citation. The contractor testified that he did not read the criminal history section of the PHO because he had never been arrested. In addition, it was not feasible that the contractor would omit an alcohol related citation on the PHQ when on the same form he disclosed the use of an illegal drug.
