Oyster Creek Environmental Impact Statement NRC has received a letter from National Oceanic and Atmospheric Administration with regard to the Supplemental Engironmental Impact Statement for the renewal of the operating license for Oyster Creek.

Essentially, the National Marine Fisheries Service states that they do not concur on the environmental impact statement. Without their concurrence NRC cannot issue the license renewal.

The words in the letter read:

"NMFS does not concur with the conclusions of the essentialfish habitatassessment. The history of the plant operation... shows that thermal, entrainment,and impingement impacts are directly impacting essential fish habitatspecies and theirprey species ... prey items consumed by twelve essential fish habitatspecies are regularly entrainedor impinged at Oyster Creek ... To minimize impacts on essential fish habitat ... NMFS recommends ... Implement the best available technology to to mitigate impingement, entrainment,and thermal impacts. This is apparentlybest repressentedby the use of cooling towers to place the plant on a closed cycle cooling system."

This has the potential to be a deal breaker, given that AmerGen has previously stated (during the New Jersey water permit renewal hearings) they won't go forward if they have to put in coolling towers.
