Documentation of Communication with NJ DEP I just got a call from Ron Zak from the State of NJ BNE. He wanted to notify us of the state's intention to inform the public of past issues where OC has not met commitments made in regard to DW leakage monitoring.

Regarding water from tell-tale drains in March 06, the state of NJ feels the issue of not meeting commitments should be part of the inspection report. The NRC, during the license renewal inspections /

audits has become aware of commitments that were made in 1996 by GPUN that have not been fully maintained. The NRC has indicated that they will document some of this information in their inspection report that will be issued within 45 days after the public meeting on 9/13. The state feels that his may be too late to adequately inform the public of their concerns, and is considering the issuance (handing out) of their letter stating their concerns at the public meeting Wed. night. They intend to hand out their letter "in the event the NRC does not adequately represent what has happened to the public".

Ron Zak read me the draft letter so we would not be "blind-sided" as he put it, by the state's intentions.

The theme of the letter is as follows:

BNE states that we have failed to maintain commitments identified during the evaluation of DW monitoring activities. In March 06, during a walk down of the torus Rm. at OC there was an observed an amount of water in poly bottles (Some were overflowing) that had not been emptied for about 6 yrs. Also, strippable coating was not used during each refueling as committed. The water was emptied without and sampling /

analysis of the water to determine source. The emphasis is on the fact that OC has prior commitments that were not met.

This issue needs prompt attention to get all the facts and details understood by those that will be attending the meeting to represent OC on Wednesday night. Earlier this morning I suggested a meeting with Engineering to inform the Sr mgmt of the events that have taken place with these bottles since March.
