SUBJECT: COOPER NUCLEAR STATION - REPLY TO DENIAL OF NONCITED VIOLATION
(NRC INSPECTION REPORT 05000298/2005002)
Dear Mr. Edington:
Thank you for your letter of June 8, 2005, in response to NRC Integrated Inspection Report
05000298/2005002, dated April 29, 2005, which documented a noncited violation concerning
the failure of operators at Cooper Nuclear Station to implement the emergency plan during an
actual plant event. On March 14, 2005, a fire started in the multipurpose facility located inside
the protected area that took longer than 10 minutes to extinguish. Cooper Nuclear Station's
Emergency Plan Implementing Procedures state that a fire within the protected area which
takes longer than 10 minutes to extinguish meets the criteria for declaring a Notification of
Unusual Event. A Notification of Unusual Event was not declared by the control room operators
despite the fact that the fire lasted for approximately 24 minutes.
In your letter, you denied the noncited violation stating that there were actually two separate
fires on March 14, 2005, and that each of these fires was extinguished within 10 minutes. As a
result, the criteria for declaring a Notification of Unusual Event was not met. You also stated
that NPPD would like the opportunity to meet with the NRC to discuss the basis for the noncited
violation and understand the generic aspects and difference in positions.
In coordination with your staff, a public meeting to discuss this issue has been scheduled for
July 13, 2005, at 12 noon in the NRC's Region IV office in Arlington, Texas. The NRC will defer
a decision on this contested violation until after this meeting has been held.
