Dear Mr. Pearce:

By letter to the Nuclear Regulatory Commission (NRC) dated October 4, 2004, FirstEnergy Nuclear Operating Company (FENOC, the licensee) submitted a license amendment request for BVPS-1 and 2. The proposed amendment would change the BVPS-1 and 2, operating licenses to increase the maximum authorized power level from 2689 megawatts thermal (MWt) to 2900 MWt. This proposed change represents an increase of approximately 8 percent above the current maximum authorized power level. The NRC staff performed an acceptance review of the application to determine whether or not there was sufficient detail to allow the NRC staff to proceed with its detailed technical review and to ensure that the application adequately characterized the regulatory requirements and licensing basis of the plant. The NRC provided the results of its acceptance review by letter dated January 6, 2005, and indicated that the application did not have sufficient information for the NRC staff to begin its review in 6 areas.

The NRC staff stated that the licensee should respond and provide the missing information within 60 days and that if it could not provide the information it should notify the staff in writing so that a new submittal date could be agreed upon. The NRC staff stated that it would consider the licensees application complete such that a review schedule could be established and the review begun upon receipt of the missing information. The licensee supplemented its application by letter dated February 23, 2005, providing additional information in 5 of the 6 areas. The licensee stated that the information in the remaining area of probabilistic safety would not be able to be provided until June 30, 2005.

The purpose of this letter is to provide the results of the NRC staff's acceptance review of the EPU additional information for BVPS-1 and 2, contained in the February 23, 2005, supplement.

The NRC staff has reviewed your February 23, 2005, supplement and concluded that it provides technical information in sufficient detail to enable the NRC staff to begin its review in the 5 areas addressed by the enclosure to the NRC staffs January 6, 2005, letter.

Upon receipt of information that adequately addresses the remaining deficiencies, the NRC staff will consider your application complete, such that the detailed technical review can be initiated and a schedule for completing our review can be established. If the response cannot be provided by the previously specified date of June 30, 2005, FENOC should notify the NRC staff in writing and provide justification for the delay and why the licensees application should
