Dear Mr. Caldwell:

The purpose of this letter is to notify the Nuclear Regulatory Commission (NRC) that some information provided by the Davis-Besse Nuclear Power Station (DBNPS) in a prior submittal may not have been complete and accurate in all material respects as required by 10CFR50.9(a).

It has been determined that none of the incomplete or inaccurate information has a significant implication for public health and safety or common defense and security, and these conditions are not being reported under 10CFR50.9(b). This letter informs the NRC of this matter in accordance with station procedures only.

The potentially incomplete or inaccurate information was discovered during our review of a sample of regulatory submittals to determine the extent of condition to address the Davis-Besse 0350 Oversight Panel Restart Checklist Item 3.i, Process for Ensuring Completeness and Accuracy of Required Records and Submittals to the NRC. Checklist Item 3.i was added by NRC letter to FirstEnergy Nuclear Operating Company (FENOC) dated January 28, 2003 (Reference Davis-Besse Letter Number Log 1-4336).

The review of previous submittals to the NRC is still underway. This potentially incomplete or inaccurate information was discovered as part of the second phase of FENOCs plan governing this activity. Based upon review of this individual item and its potential impact on related inspection activities, it was decided to promptly notify the NRC of this item rather than follow the established program for determining materiality of incomplete or inaccurate information.

This issue has been entered into the DBNPS Corrective Action Program to determine appropriate corrective actions.

During review of Information Notice 94-058, "Reactor Coolant Pump Lube Oil Fire, that was issued August 16, 1994, it was identified that the lift oil pump pressure switches and piping are not contained by the RCP oil collection system. No further actions were taken at that time based on the previous evaluations that the RCP oil collection system met the requirements of I OCFRSO Appendix R.
