Combustion Engineering Standard Safety Analysis Report Docket

Dear Mr. Miraglia:

This letter requests NRC adoption of a proposed docketing process for the forthcoming revisions to the Combustion Engineering Standard Safety Analysis Report.

The Combustion Engineering Standard Safety Analysis Report-FSAR (CESSAR-F), which received an NRC Final Design Approval (FDA-2) on December 21, 1983, is in the process of being revised in accordance with the Commission's Severe Accident and Standardization Pclicy Statements.

The revisions, when complete, will describe our enhanced design; System 80+M. These revisions to CESSAR-F will be submitted with the intention that they will result in a Design Certification rule as described in the Severe Accident and Standardization Policy Statements. Our application will thus be designated the Combustion Engineering Standard Safety Analysis Report - Design Certification (CESSAR-DC).

Since the System 80+ design is based on the System 80R design approved by the NRC in FDA-2, it is vital to the efficacy of any future review process that it build on the NRC's previous findings on System 80. These findings were documented in the complete record of correspondence, meetings, submittals, PDAs, FDAs, etc. which exist on docket number STN 50-470F, as well as the NRC's Safety Evaluation Reports (NUREG-0852 and its Supplements). Since FDA-2 was also relied upon in Operating License applications, we recommend that, in the future, two (2) dockets be utilized. The existing docket (STN 50-470F) could continue to be referenced by any plants which obtained a Construction Permit by referencing PDA-2. The new docket could provide the vehicle to take System 80+ throut-b a Design Certification rule. It could be referenced by future applicants seeking a Construction Permit, Operating License, or Power Systems 1000 Prospect Hill Road (203) 688 1911 Combustion Engineering, Inc.

  • - LD-87-050 September 18, 1987 Page 2 combined CP/OL. . It is important, however, that the new docket start off as an exact duplicate of the existing docket (STN 50-470F) complete with-all of its previous history and findings up to and including FDA-2.

We believe that creating a new docket for CESSAR-DC, as described above, will facilitate record-keeping and minimize confusion for both the staff and applicants. We must be certain, however, that the creation of a new docket for CESSAR-DC will not prejudice the outcome of the on-going discussions of. Combustion Engineering's position that the Design Certification review should be based on the FDA-2 findings and conducted in accordance with the Backfit Rule.
