SHEARON HARRIS NUCLEAR POWER PLANT - NRC INTEGRATED INSPECTION REPORT 05000400/2006003; PRELIMINARY WHITE FINDING

Dear Mr. Gannon:

On June 30, 2006, the NRC completed an inspection at your Shearon Harris facility. The inspection findings were documented in NRC inspection report 05000400/2006003, dated July 28, 2006. Section 1R15 of the report identified an apparent violation (AV)05000400/2006003-02, Failure to Maintain Adequate Procedures Such That a Required Torque Was Not Provided for a Threaded Fastener on an Essential Services Chilled Water (ESCW) System Chiller. This AV was identified as having potential safety significance greater than very low, pending further NRC review.

The AV of Harris Technical Specification (TS) 6.8.1 involved maintenance procedures that did not adequately address torque requirements for the train A ESCW chiller pre-rotational vane shaft to actuator linkage fastener, leading to the train A ESCW chiller being inoperable for a period of time in excess of that permitted by TS 3.7.13. An in-office review of the AV was conducted which preliminarily determined the significance of the AV to be White (i.e., issue of low to moderate safety significance and will most likely result in additional inspections by the NRC) as indicated in the enclosed Significant Determination Process (SDP) phase III analysis.

This determination was based on the best available information, including influential assumptions, using the applicable SDP. One critical assumption that differs from your analysis of this deficiency is the viability of alternate high head injection/charging pump cooling via the portable fan upon loss of the A ESCW chiller. At present we do not have sufficient confidence to credit this operation.

The finding does not represent a current safety concern since your staff took prompt actions to investigate and repair the problem. Further, the A ESCW chiller was subsequently tested successfully.

The AV involving requirements specified in TS 6.8.1 and TS 3.7.13 is being considered for escalated enforcement action in accordance with the NRC Enforcement Policy. The current Enforcement Policy is included on the NRCs Web site at http://www.nrc.gov/what-we-do/regulatory/enforcement/enforce-pol.html.

In accordance with Inspection Manual Chapter (IMC) 0609, we intend to complete our evaluation using the best available information and issue our final determination of safety significance within 90 days from such initial communication on July 28 2006.

The significance determination process encourages an open dialog between the staff and the licensee; however, the dialogue should not impact the timeliness of the staffs final determination. Before we make a final decision on this matter, we are providing you an opportunity (1) to present to the NRC, your perspectives on the facts and assumptions used by the NRC to arrive at the finding and its significance, at a Regulatory Conference or (2) submit your position on the finding to the NRC in writing. If you request a Regulatory Conference, it should be held within 30 days of the receipt of this letter and we encourage you to submit supporting documentation at least one week prior to the conference in an effort to make the conference more efficient and effective. If a Regulatory Conference is held, it will be open for public observation and the NRC will issue a press release to announce the conference. If you decide to submit only a written response, such submittal should be sent to the NRC within 30 days of the receipt of this letter.

Please contact Mr. Binoy Desai at (404) 562-4519 within 10 business days of the date of the receipt of this letter to notify the NRC of your intentions regarding the regulatory conference for the preliminary White finding. If we have not heard from you within 10 days, we will continue with our significance determination and associated enforcement processes on this finding, and you will be advised by separate correspondence of the results of our deliberations on this matter.

Since the NRC has not made a final determination in this matter, no Notice of Violation is being issued for the inspection finding at this time. In addition, please be advised that the number and characterization of the AV described in the NRC Inspection Report 05000400/2006003 may change as a result of further NRC review.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter and your response (if any) will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). However, the NRC is continuing to review the appropriate classification of the attached SDP Phase 3 Risk Analysis within our records management program, considering changes in our practices following the events of September 11, 2001.
