WATERFORD STEAM ELECTRIC STATION, UNIT 3 - NRC SECURITY INSPECTION REPORT 05000382/2017403 AND INVESTIGATION REPORT 4-2016-024

Dear Mr. Dinelli:

On December 13, 2017, the U.S. Nuclear Regulatory Commission (NRC) completed a security inspection at your Waterford Steam Electric Station, Unit 3. This letter also documents the results of an NRC investigation conducted from May 5, 2016, through May 16, 2017, at the Waterford Steam Electric Station, Unit 3. The purpose of the investigation was to determine if willful security-related violations of NRC requirements occurred at the station. On January 11, 2018, the NRC inspectors discussed these results with Mr. John Dinelli, Site Vice President and other members of your staff. The results of this inspection and investigation are documented in the enclosed report.

The NRC inspector documented a finding of very low security significance (Green) in this report.

This finding involved a violation of NRC requirements. The NRC is treating this violation as a non-cited violation consistent with Section 2.3.2.a of the Enforcement Policy.

Further, the inspector documented a licensee-identified violation which was determined to be of very low security significance in this report. The NRC is treating this violation as non-cited violation (NCV) consistent with Section 2.3.2.a of the Enforcement Policy.

If you contest the violations or significance of the non-cited violations, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555 0001, with copies to the Regional Administrator, Region IV; the Director, Office of Enforcement, the Director, Office of Nuclear Security and Incident Response; and the NRC resident inspectors at the Waterford Steam Electric Station, Unit 3. If you disagree with a cross-cutting aspect assignment you should provide a response within 30 days of the date of this inspection report, with the basis for your disagreement, to the U.S.

Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555 0001; with copies to the Regional Administrator, Region IV and the NRC resident inspectors at Waterford Steam Electric Station, Unit 3.

One cross-cutting aspect was assigned to a finding in the areas of Problem identification and resolution, self-assessment. Specifically, the organizations routine assessments of its programs and practices were not sufficiently self-critical and objective [P.6].

This letter will be made available for public inspection and copying at http://www.nrc.gov/reading-rm/adams.html and at the NRC Public Document Room in accordance with 10 CFR 2.390, Public Inspections, Exemptions, Requests for Withholding.

However, the enclosed report contains Security-Related Information, so the enclosed report will not be made publically available in accordance with 10 CFR 2.390(d)(1). If you choose to provide a response that contains Security-Related Information, please mark your entire response Security-Related Information - Withhold from Public Disclosure under 10 CFR 2.390 in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). The NRC is waiving the affidavit requirements for your response in accordance with 10 CFR 2.390(b)(1)(ii).
