WATERFORD STEAM ELECTRIC STATION, UNIT 3 - NRC SECURITY INSPECTION REPORT 05000382/2012202

Dear Ms. Jacobs:

On May 4, 2012, the U.S. Nuclear Regulatory Commission (NRC) completed an inspection at your Waterford Steam Electric Station, Unit 3. The inspection covered one or more of the key attributes of the security cornerstone of the NRCs Reactor Oversight Process. The enclosed inspection report documents the inspection results, which were discussed via telephone on May 11, 2012, with you and other members of your staff.

On May 29, 2012, the NRC Team Leader re-exited via telephone with Tommy Sanders (Acting Security Manager) and other members of your staff regarding an unresolved item 0500382/2009201-3 which has been closed as a minor violation.

The inspection examined activities conducted under your license as they relate to security and compliance with the Commissions rules and regulations and with the conditions of your license.

The inspectors reviewed selected procedures and records, observed activities, and interviewed personnel.

One NRC-identified finding of very low security significance (i.e., Green as determined by the Emergency Preparedness Significance Determination Process) was identified during this inspection. The deficiency was promptly addressed and entered in the corrective action program, and the plant was in compliance with applicable emergency preparedness requirements within the scope of this inspection before the inspectors left the area.

One cross-cutting aspect was assigned to a finding in the area of Problem Identification and Resolution, in that the licensee identifies such issues completely, accurately, and in a manner commensurate with their safety significance. [P.1.(a)]

This finding was determined to involve a violation of NRC requirements. However, the NRC is treating the violation as a non-cited violation (NCV) consistent with Section 2.3.2 of the Enforcement Policy. If you contest this NCV in the enclosed report, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001; with copies to the Director, Office of Nuclear Security and Incident Response, Nuclear Regulatory Commission, Washington, DC 20555-0001; the Director, Office of Enforcement, Nuclear Regulatory Commission, Washington, DC 20555-0001; and the NRC Resident Inspector at Waterford.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390 of the NRC's

"Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, the material enclosed herewith contains Safeguards Information as defined by 10 CFR 73.21 and its disclosure to unauthorized individuals is prohibited by Section 147 of the Atomic Energy Act of 1954, as amended. Therefore, the material in the enclosure will not be made available electronically for public inspection in the NRC Public Document Room or from the NRC's document system (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html. If Safeguards Information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21. Otherwise, if security-related information is necessary to provide an acceptable response, please mark your entire response Security-Related Information in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.
