NOTICE OF VIOLATION (NRC INSPECTION REPORT 50-341/98002(DRS))
Dear Mr. Gipson:
This acknowledges receipt of your April 24,1998, letter in response to our March 25,1998, letter which transmitted a Notice of Violation (NOV) associated with the above mentioned inspection report. This report summarized the results of the maintenance rule baseline inspection at the Detroit Edison Enrico Fermi, Unit 2, facility. The report identified three

violations. In the response, Detroit Edison did not contest two of the violations, but did contest violation 50-341/98002-05(DRS) conceming the monitoring of the high pressure coolant injection (HPCI) system. For the non-contested violations, we have reviewed your corrective actions and have no further questions at this time with respect to your corrective actions. The corrective actions that were described will be examined during future inspections.'
For the violation Detroit Edison has contested, we reviewed the additional information in your response, which provided the basis for your position to dispute the violation.- Specifically, based on information contained in the Updated Safety Analysis Report, Section 3.4.4, * Flood Protection," the condensate storage tank was seismically analyzed using design basis earthquake (DBE) loads, and found to be well within the allowable stress limits. As such, the HPCI system function within the maintenance rule scope would have remained functional

following a DBE, in that, during an accident the suction transfer for high torus water level would have occurred. Had this additional information been presented during the inspection, no violation would have been issued, and we are withdrawing the violation.
