Inspection No. 50-309/88-10 This refers to your letter dated August 11, 1988, in response to our letter dated July 7,1988.

Thank you for informing us of the corrective and preventive actions documented in your letter. These actions will be examined during a future inspection of your licensed program.

With regard to your request that we reconsider the severity level of the violation; we have reviewed the categorization of the violation and have determined that the violation was appropriately categorized at a Severity Level III. Specifically 10 CFR 2, Appendix C, Supplement V, Section C.3.c states that a Severity Level III Violation is any noncompliance with require-ments that results in the improper transfer of material.

In addition, we have discussed this categorization with NRC Headquarters personnel and have determined that a Severity Level III violation is appropriate.

Subject: Response to Notice of Violation (Inspection No. 50-309/88-10)

Gentlemen:

This letter is in response to your letter of July 7,1988, notifying Maine Yankee of a Severity Level III violation.

This violation involving failure to transfer radioactive material to an Agreement State licensee in accordance with the Agreement state license requirements was identified by the Agreement State, South Carolina.

The waste shipment in question did not violate any specific Federal packaging or shipping requirements.

The violation, its root cause and the corrective actions that have or will be taken by Maine Yankee, have been discussed with state officials at a meeting in South Carolina. He have also made a written submittal to the state describing the actions we have taken to prevent future non-conformance with state regulations.

The State of South Carolina has reviewed our submittal and has agreed with our identification of the cause of the violation and with the actions we have taken to prevent recurrence of this type of incident.

As a consequence of this favorable review, the state has lif ted the suspension of our South Carolina Haste Transport Permit.

The waste shipment in question has been returned to Maine Yankee for repacking.

Condition 38 of the Chem-Nuclear System radioactive materials license issued by South Carolina limits the activity of material to be accepted as Class A unstable wu te to less than 1 uC1/cc for nuclides with half-lives greater than five years.

The shipment did not violate any specific federal regulations for radioactive

material shipping except one that required meeting state requirements. A review of similar violations at other facilities indicates that similar violations are typically categorized as Level IV.
