NRC INSPECTION REPORT 50-275/96023; 50-323/96023 AND NOTICE OF VIOLATION

Dear Mr. Rueger:

An NRC inspection was conducted from November 10 through December 21, 1996, at your Diablo Canyon Nuclear Power Plant, Units 1 and 2 reactor facilities. The enclosed report presents the scope and results of that inspection.

During the inspection period, your conduct of activities at the Diablo Canyon facility was generally characterized by safety conscious operations.

Plant management's reaction to 4kV first level undervoltage relay operability concerns was decisive and demonstrated appropriate concern for both safety and compliance with Technical Specification requirements.

Four violations were identified during the inspection period.

The first involved the failure to follow procedural requirements for the control of temporary modifications.

The second violation involved the failure to document loose fasteners installed on 480V switchgear as required by procedure.

The third violation involved the failure to take corrective actions for repeatedly exceeding the specified maximum allowed time delay in Technical Specifications for the 4kV first level undervoltage relay.

The fourth violation involved missed reviews by the Plant Staff Review Committee of 10 CFR 50.59 safety evaluations as required by the Technical Specifications.

While all of the violations are of concern, the violation associated with the Plant Staff Review Committee missed reviews of 10 CFR 50.59 evaluations is of particular concern because it represents a failure of a barrier that you had established to assure that any potential unreviewed safety questions are identified.

The violations are cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding the violations are described in detail in the enclosed report.

Please note that you are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response.

In addition to these cited violations, another violation was identified involving the inoperability of the component cooling water system under certain degraded voltage conditions.

As discussed in more detail in Section E8.1 of the inspection report, PG5E discovered this condition, which was not likely to be discovered as the result of routine surveillance or quality assurance activities, and took prompt and comprehensive corrective action.

In accordance with the provisions of Section VII.B.3 of the "General Statement of Policy and Procedures for NRC Enforcement Actions," NUREG-1600, and after consultation with the Director, Office of Enforcement, I have been authorized to exercise enforcement discretion in this case and not issue a Notice of Violation for this violation.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice,"

and your response will be placed in the NRC Public Document Room (PDR). To the extent possible, your response should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.
