SUBJECT:
NRC INSPECTION REPORT 50-275/96024; 50-323/96024 AND NOTICE OF VIOLATION
Dear Mr. Rueger:
On December 22, 1996, through February 1, 1997, the NRC completed an inspection at your Diablo Canyon Nuclear Power Plant, Units 1 and 2 reactor facilities. The enclosed report presents the scope and results of that inspection.
During the inspection period your conduct of activities at the Diablo Canyon Facility was generally characterized by safety-conscious operations and good maintenance and engineering practices; however, two violations were identified.
The first involves the failure to perform a written safety evaluation prior to changing reactor protection trip setpoints.
Although a formal review was performed, all of the specific attributes required by 10 CFR 50.59 were not considered.
'The second violation involves the failure to follow the process established by procedure for. the revision of design criteria memoranda.
The violations are cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding these violations are described in detail in the enclosed report.
Please note that you are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response.
The NRC will use your response, in part, to determine whether further enforcement action is necessary to 'ensure compliance with regulatory requirements.
In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice,"
a copy of this, letter, its enclosures, and your response will be placed in the NRC Public Document Room (PDR).
To the extent possible, your response should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.
