Rueger, Senior Vice President Nuclear Power Generation Thank you for your letter dated December 30, 1991, in r'esponse to our Notice of Violation (Notice) and Inspection Repor't 50-275/91-29 and 50-323/91-29, informing us of the steps you have taken to correct the items we brought to your attention.

In your response you state that you believe the exemption expressed in 10 CFR 20. 203(f)(3)(vii ) applies= and that you should not have been required to label the High Integrity Container (HIC) identified in violation A. 1 of our Notice.

Since the HIC was not attached to the resin transfer system at the time of the observation and was located outside the auxiliary building at the 115 foot level in a radioactive material, storage area, we do not agree the exemption would be applicable.

Me concur with the corrective actions described in paragraph A.3 of your December 30, 1991, letter.

Your corrective actions will be verified during a future inspection.

Should you have any questions regarding this matter, we would be glad to discuss them with you.
