Report Nos. 15000039/10BC 781-2E 50-270/81-25 and 50-287/81-25 This refers to an unannounced inspection conducted by M T. C. MacArthur of this office on September 28, 198 Areas examined during the inspection and our findings are discussed in the enclosed Inspection Report. Within these areas, the inspection consisted of a review of the shipping papers, placarding and labeling requirements, radiation measurements, selective contamination surveys, and observations by the inspecto A shipment of radioactive waste shipped from your Oconee facility was inspected upon arrival at the Chem-Nuclear Systems, Inc., Barnwell, South Carolina disposal sit During the inspection, it was found that certain activities under your license appear to violate NRC requirement This item and references to pertinent requirements are listed in the Notice of Violation enclosed herewith as Appen dix A. The violation for which you are being cited was the subject of enforce ment action by the State of South Carolin On September 25, 1981, the State of South Carolina imposed a fine of $1000 for this violatio In view of the circumstances surrounding this matter, we have exercised our discretion under the Interim Enforcement Policy (45 FR 66754) October 7, 1980, and have chosen to issue at this time the enclosed Notice of Violation. After reviewing your response to this Notice of Violation and your proposed corrective actions, the NRC will determine whether further NRC enforcement action is necessary in order to ensure compliance with NRC regulatory requirement In accordance with 10 CFR 2.790(a),
a copy of this letter and the enclosures will be placed in the NRC's Public Document Room unless you notify this office, by telephone, within ten days of the date of this letter and submit written application to withhold information contained therein within thirty days of the date of this letter. Such application must be consistent with the requirements of 2.790(b)(1).
