SUBJECT:

REVIEW OF THE RESPONSE TO NOTICE OF VIOLATION FOR POINT BEACH NUCLEAR PLANT (NRC INSPECTION REPORT NO. 50-266/97017(DRP);

L 50-301/97017(DRP))

Dear Mr. Grigg:

' This will acknowledge receipt of your letter dated December 12,1997,'in response to our letter j

dated September 17,1997, transmitting a Notice of Violation associated with inspection Repost i

No. 50 266/97017(DRP); 50-301/97017(DRP).

In your reply, you stated that while not disputing Violation 1, it was your view that the statement

at issue regarding the cross-connecting capability of the Point Beach component cooling water j

. (CCW) system was perhaps incomplete, but it was not inaccurate. We have carefully reviewed j

l

,

your response and the circumstances of this violation and have concluded that the statement Point Beach management made to us both verbally and in writing clearly related to the CCW.

'

_

. system cross-connect capability through the flow path specified in your abnormal operating

'~

L procedures. Since it was later determined that this flow path was not available, we have

j:

concluded that our characterization of the violation was correct. Mr. John A. Grobe, Director,

'

Division of Reactor Safety, discussed this matter with you. We acknowledge your position that

.

the statement was also incomplete, in that there was another CCW system cross-connect

,

capability beyond that described in your abnormal operating procedures.. We also acknowledge

'

your belief that had it been necessary, the CCW system likely would have been made functional.

!

We have reviewed your corrective actions and have no further questions at this time.' These

,

l corrective actions will be examined during future inspections.

L

Sincerely,

,

j

!.
