This refers to your letter dated April 4,1989 in response to our letter datN February 22, 198 In your letter you indicate that you do not agree with the two violations iden-tified in our letter. We again reviewed the requirements which we believe were violated as well as the basis for your disagreement. With respect to Violation A, for the r.easons stated in the enclosure to this letter, we find that the violation is correct as cited. Notwithstanding your disagreement with the vio-lation', we- acknowledge _ your proposed corrective actions and will review thest actions during subsequent inspection With respect to Violation B, we concur that our statement indicating that the event was reported by you to the NRC Operatiuns Center on November 9,1988, was incorrect. That statement was made based upon a misunderstanding of the facts related to the_ event. However, since you appropriately deliberated the ques-tion of deportability, as implied in your' response to the violation, and mad conscious decision that the event did not rise to the significance of requiring a prompt report, we have determined that the violation should not have been cited, It is, therefore, retracted and our records will be' revised accord-ingl Our guidance regarding the deportability of security-related events, as stated-in your response, remains unchanged; however, it is incumbent upon licensees to comply with 10 CFR 73.71 based upon reasonable and responsible deliberatio
