Subject:

PROPOSED INFOSITION OF CIVIL PENALTIES - $125,000 This is to inform the Comission that a Notice of Violation and Proposed Irposition of Civil Penalties in the amount of One Hundred Twenty-five Thousand Dollars ($125,000) will be issued on or about Septerber 15, 1988 to Comorwealth Edison Company. This action is based on two problems. First, the shared diesel was unable to respond for approxinately six months, to a Unit 2 auto-start signal because of an undetected failure caused by a wiring error. Second, the ungrounded 125 VCC battery system for Unit 2 was operated in a grounded condition for approximately six renths. This condition was not properly recognized or evaluated by the licensee. The escalation and mitigation factors of the Enforcement Policy were considered for buth of these violatices and the civil penalty for the first violation was escalated 50 percent because of the licensee's failure to take prorpt and thorough corrective actions while the second violation is being proposed at the base civil penalty.

It should be noted that the licensee has not been specifically infomed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice September 15, 1968 Telephone Notification of Licensee September 15, 1988 The State of Illinois will be notified.

The licensee has thirty days from the date of the Notice in which to rcspond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
