IMPOSITION OF CIVIL PENALTY - $75,000 By EN 88-85 dated October 17, 1988 the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of One Hundred Fifty Thousand Dollars ($150,000) to Commonwealth Edison Company. This action was based on a violation of the equipment qualifi-
-cation requirements of 10 CFR 50.49.
The licensee responded to the Notice in two letters dated November 21, 1988.
After careful consideration of the licensee's response, the staff has concluded that the violation did occer as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty. The original proposed civil penalty has been reduced by 50%, after the staff's reconsideration of the escalation of the proposed penalty for the licensee's failure to identify the violations.
Accordingly, an Order Imposing Civil Penalty in the amount of $75,000 has been issued today.
Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
