OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:
Commonwealth Edison Company (EA 97-466)

Subject:
PROPOSED 'MPOSITION OF civil PENALTY - $55,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the tmount of $55,000 will be issued on or about March 3,1998 to Commonwealth Edison Company. This action is b3ed on a Severity Level lli problem consisting of violations involving the failure to adequately implement 10 CFR 50.65, " Requirements for Monitoring the Effectiveness of Maintenance at Nuclear Power Plants" (the Maintenance Rule). While the actual safety consequence of each violation was low, they have high regulatory significance in that they represent a lack of effective oversight and a programmatic breakdown in the impl: mentation of the Maintenance Rule.
B:cause this was not the first escalated enforcement action within 2 years, the staff considered whether credit was warranted for identification and corrective action. Credit was not warranted for identification because the NRC identified the problem. Credit was warranted for the factor of corrective action because the licensee's corrective actions were considered both prompt and comprehensive. Consideration of these factors resulted in the civil penalty being proposed at the base amount of $55,000.
It should be noted that the licensee has not been specifically informed of the enforcement action. The sch:dule of issuance and notification is:

Th] licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the re:ponse, the civil penalty may be remitted, mitigated, or imposed by Order.
