The rationai basis, therefore, lies in its commercial utility and the competitive advantage it affords the owner.

In response to your earlier request, we have prepared an update on the software status for the use of the University of Illinois in responding to any further specific request by the U.S. Nuclear Regulatory Commission (NRC) on this subject. This software status lists all changes made to GA's software after our previous status report of October 8, 1992. The software updates listed below were made specifically for the University of Illinois I&C system. With the execption of one product improvement and one display modification, these changes were made to accomodate the operation of the fast transient rod. GA continues to consider this information as proprietary information, and requests that it be afforded the requisite protection by the NRC as provided under 10 CFR 2.790. An affidavit supporting this request ic enclosed as required by 10 CFR 2.790(b) (1) . In providing the attached document to the NRC, please include this af fidavit along with an application by the University to the NRC which includes the reasons listed above in this letter, as required by 10 CFR 2.790(b) (1) (ii) . Further, in responding to the NRC, you must provide both a proprietary and a non-proprietary version of the information. The non-proprietary version has the proprietary information blacked out and will eventually find its way into the public document room. Hyde to Richard Holm which forms the basis for a GA requested application by the University of Illinois for withholding specific documents from public disclosure, as well as having reviewed the content of the two documents. The specific GA document to be withheld is: University of Illinois Specific I&C System Software - Modifications The information contained in the said document has been held in confidence by GA. It is made available only to those who must know it in order to evaluate the safety characteristics of the system. It is made available to the University of Illinois upon the NRC's explicit request and is so provided in confidence. The information contained in " University of Illinois Specific I&C System software Modifications" was developed at private expense for commercial purposes and is of a type customarily held in confidence by an owner. The rational basis, therefore, lies in its commercial utility and the competitive advantage it affords the owner. Accordingly, GA directs the University of Illinois to ask the NRC to handle such information in confidence. It is not available from public sources, and its disclosure by the NRC would cause substantial harm to GA's competitive position in a wholesale market valued at approximately $1 million per year. GA has expended approximately $1,100,000 of private funds in developing the systems which incorporate the trade secrets described in this document, so the value ratio between that development cost and indicated market is substantial.
