NOTICE OF VIOLATION

B&W Fuel Company Docket No. 70 1201 4 Lynchburg, Virginia License No. SNM 1168 i

During an NRC inspection conducted September 10, 13, and 23, 1996, a violation of NRC requirements was identified. In accordance with the " General Statement i of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the  !

violation is listed below:

License Condition 10 of Materials License SNM 1168 requires the licensee i to comply with all listed conditions in the following two sections: l Safety Conditions and Safeguards Conditions.

t Safety Condition S-1 requires the licensee to comply with the ,

statements, representations, and conditions in Part I of the Application dated June 22, 1990, and supplements thereto.

Part I, Chapter 5, Section 5.2 of the Application, requires the licensee to conduct the environmental monitoring program in accordance with approved procedures which require the generated data to be evaluated against internal action levels.

Radiation Protection Procedure, RP 011, Environmental Monitoring, Revision 3, June 21, 1995, Step 14.1 requires the Health Physicist to evaluate environmental sample results which exceed the evaluation levels specified in Exhibit B of the procedure.

Contrary to the above, the licensee failed to review, document the results of the review, and take appropriate corrective actions for a vegetation sample collected in May 1995 that exceeded licensee action limits.

This is a Severity Level IV violation (Supplement VI).

Although Section 2.201 requires B&W Fuel Company to submit to this office, within 30 days of the date of the letter transmitting this Notice of Violation (Notice) a written statement of explanation, this violation had been corrected and those actions were reviewed during this inspection. Therefore, no response with respect to this matter is required.
