ENCLOSURE 1 NOTICE OF VIOLATION Babcock and Wilcox Company Docket No. 70-1201 Lynchburg, VA License No. SNM-1168 During the Nuclear Regulatory Commission (NRC) inspection conducted on July 8-10, and 16, 1986, a violation of NRC requirements was identified. The violation involved the failure to adequately brace a shipment of radioactive material to prevent movement in transit. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the violation is listed below:

10 CFR 71.5 requires that each licensee who transports licensed material outside of the confines of its plant or other place of use, or who delivers licensed material to a carrier for transport, shall comply with the applicable requirements of the regulations appropriate to the mode of transport of the Department of Transportation in 49 CFR Parts 170-189.

49 CFR 173.425(b)(6) requires that shipments of low specific activity (LSA) radioactive materials by exclusive use vehicles must be braced so as to prevent shifting of lading under conditions normally incident to transporta-tion.

Contrary to the above, on July 7,1986, due to inadequate bracing, a container of uranium hexafluoride, shipped as LSA material, underwent a shift of lading during transport and fell from the transport vehicle onto the roadway.

This is a Severity Level IV violation (Supplement V).

Pursuant to the provisions of 10 CFR 2.201, Babcock and Wilcox Company is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including:

(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
