NOTICE OF VIOLATION B&W Fuel Company Docket No. 70-1201 Commercial Nuclear Fuel Plant License No. SNM-1168 During the Nuclear Regulatory Commission (NRC) inspection conducted on February 1-3, 1988, a violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violation is listed below:

10 CFR 20.105(b)(2) requires that no licensee possess, use or transfer licensed material in such a manner as to create in.any unrestricted area j

from radioactive material and other sources of radiation in his possession radiation levels which, if an individual were continuously present in the I

area, could result in his receiving a dose in excess of 100 millirems in any seven consecutive days, Contrary to the above, during the period of December 3-9, 1987, and January 29-February 3,1988, radiation levels at the unrestricted area fence in the vicinity of Building ECH0-330 were 1.0 and 0.7 inillirems per hour respectively and if an an individual were continuously present in the area, a dose in excess of 100 millirems could have been received.

4 This is a Severity Level IV violation (Supplement IV).

Pursuant to the orovisions of 10 CFR 2.201, B&W Fuel Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Comission, ATTN:

Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a "Reply to a Notice of Violation" and should include:

(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective i

steps which have been taken and the results achieved. (4) the corrective steps 1

which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time.
