t NOTICE OF VIOLATION

Framatome Cogema Fuels Docket No. 70-1201 Lynchburg Manufacturing Facility License No. SNM-1168 During an NRC inspection conducted on May 24 through 28,1999, violations of NRC requirements were identified, in accordance with the " General Statement of Policy and Procedures for NRC Enforcement Action," NUREG-1600, the violations are listed below:

A. License Condition No. S-1 of Special Nuclear Material License No.1168 (SNM-1168) requires the licensee to comply with statements, representations, and conditions contained in Part i of the License Application dated June 22,1990, and supplements thereto.

Part I, Chapter 2, Section 2.6 Operatinqi Procedures, states that operating procedures which involve SNM shall be reviewed at least every two years by the appropriate .

Contrary to the above, four operating procedures involving SNM were not reviewed at least every two years by the appropriate production manager and Manager, Radiation Protection. These procedures included:

MA-132, Fuel Assembly Container Unpacking, Loading, atW Preparation for Retum from Reactor Sites, last reviewed November 11,1995 MA-269, Fuel Assembly Packaging, Shipping, and Container Storage at Site, last reviewed May 5,1997 MA-307, Packaging and Vault Storage of UO2 Material, last reviewed October 15, 1996 MA-311 Domestic UO, Pellet Receiving, last reviewed February 27,1997 This is a Severity IV violation (Supplement VI).

B. License Condition No. SG-2.1 of SNM License No.1168 states that the licensee shall follow the Security Plan dated May 16,1980, as revised May 20,1983, February 5, 1986, and August 28,1992, ans as revised in accordance with the provisions of 10 CFR 70.32 (e).

The Security Plan states that Gate 6 of the perimeter fence to the Controlled Access Area is to remain closed and locked, except when attended or in use.

NOV 2 Contrary to the above, on May 25,1999, the inspector observed that Gate 6 was not closed and locked, and was not attended or in use.

This is a Seventy IV violation (Supplement VI).

C. License Condition No. S-1 of SNM License No.1168 requires the licensee to comply with statements, representations, and conditions contained in Part I of the License Apphcahon dated June 22,1990, and supplements thereto.

Chapter 3.1.4 of the License Applicaten requires alllicensed activities related to radiabon protechon to be conducted in accordance with approved written procedures.

Procedure SL-1250, Bioassay Program, Revision 1, required participants in the Uranium Bioassay Program provide an in-vitro analysis (unne sample) and an in-vivo measurement (lung count) on a semi-annual basis.

Contrary to the above, the licensee failed to perform the semi-annual in-vitro bioassay for the second half of Calendar Year 97. -

This is a Severity Level IV violation (Supplement VI).

The NRC has concluded that information regarding the reason for the violations, the corrective actions taken and planned to correct the violations and prevent recurrence and the date when full compliance will be achieved is already adequately addressed on the docket in the enclosed inspechon report. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective schons or your position. In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region ll, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
